Terms of Service

These Terms of Service ("Terms") govern your use of SOS Cat and all associated services. By downloading, installing, accessing, or using SOS Cat, you agree to be bound by these Terms.

If you do not agree to these Terms, you should not access or use SOS Cat.

1. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to use SOS Cat for personal, non-commercial smoking cessation purposes only.

You agree not to:

• Modify, reverse-engineer, decompile, or attempt to extract the source code of the application

• Use the application for any unlawful, fraudulent, or unauthorized purpose

• Attempt to gain unauthorized access to our servers, databases, or systems

• Interfere with the security or operation of the application

• Remove or alter any copyright, trademark, or proprietary notices

2. Medical Disclaimer

IMPORTANT: SOS Cat is a self-help smoking cessation tool and is NOT a substitute for professional medical advice, diagnosis, or treatment.

• Recovery percentages, health improvements, money saved, smoking behavior statistics, reduced smoking frequency, smoke-free time, achievements, milestones, and all other statistics displayed within the application are informational estimates only. These estimates may be based on user-provided information, public research, or internal calculations and should not be interpreted as medical advice, diagnoses, guarantees, or predictions of future outcomes.

• Nicotine addiction is a medical condition. If you are using prescription nicotine replacement therapy (NRT), prescription medications, or receiving professional treatment, consult your healthcare provider before making healthcare decisions.

• If you experience severe withdrawal symptoms, mental health concerns, chest pain, breathing difficulties, or any other medical emergency, seek immediate medical assistance.

• Your use of SOS Cat is at your own risk. We make no guarantees regarding smoking cessation success rates, health outcomes, or behavioral results.

3. User Content

• You retain ownership of any content you create, submit, or store within SOS Cat, including smoking logs, journal entries, notes, and other personal data.

• By using SOS Cat, you grant us a limited license to store, process, transmit, and display your content solely as necessary to provide and maintain the service.

• We will not share your personal content with third parties except:

• With your consent;

• As required by applicable law;

• To protect legal rights or prevent fraud;

• As necessary to provide the service through trusted service providers.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• SOS Cat is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

• We do not guarantee that the application will be uninterrupted, error-free, secure, or free of defects.

• We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, loss of profits, loss of goodwill, health outcomes, or business interruption.

• We are not responsible for the acts, omissions, privacy practices, or services of third-party providers, including Firebase, Google services, Supabase, Apple Sign In, or other integrated services.

• Our total aggregate liability arising from or relating to the service shall not exceed the amount paid by you to us during the twelve (12) months preceding the claim, or USD $50, whichever is greater.

5. Termination

• You may stop using SOS Cat and delete your account at any time.

• We may suspend or terminate access to the service if you violate these Terms, engage in unlawful conduct, or abuse the platform.

• Upon account deletion, personal data will be deleted immediately or within thirty (30) days, except where retention is required by applicable law.

6. Intellectual Property

• SOS Cat, including its software, design, branding, logos, artwork, illustrations, mascots, user interface, content, and features, is protected by copyright, trademark, and other intellectual property laws.

• All rights not expressly granted to you are reserved by SOS Cat.

• You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any portion of the application without prior written permission.

7. Indemnification

You agree to indemnify, defend, and hold harmless SOS Cat, its owners, affiliates, contractors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the application;

• Your violation of these Terms;

• Your violation of applicable laws or regulations;

• Your infringement of any third-party rights.

8. Subscriptions and Payments

If premium features, subscriptions, or paid services are offered:

• Payments will be processed through Apple App Store, Google Play, or other authorized payment providers.

• Subscriptions automatically renew unless canceled before the renewal date.

• You may manage or cancel subscriptions through your Apple App Store or Google Play account settings.

• Refund requests are governed by the refund policies of the platform through which the purchase was made.

• Pricing may change in the future, subject to applicable platform rules and notice requirements.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Taiwan.

If you are a consumer located in the European Union or another jurisdiction that provides mandatory consumer protections, those protections will continue to apply to the extent required by law.

10. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we will update the "Last Updated" date and may provide additional notice within the application where required by law.

Your continued use of the service after such updates constitutes acceptance of the revised Terms.
